Terms and Conditions

Apologies for the formality and abundance of boring text but it is essential for your own safety and enjoyment that you take the time to read our Terms and Conditions for your booking. Our Terms and Conditions must be read in full before booking.


“We/Us/Our” means Wild Kabn Kitchen LLP of The Granary, Hermitage Court, Hermitage Lane, Maidstone, Kent, United Kingdom, ME16 9NT.


“You/Your” means a user of this Website and/or customer of Ours.


“Location/Site/Venue” means the property where the supper clubs, private dining and cooking classes will take place.


Terms and Conditions


A contract between You and Us will come into existence when payment is received and a booking confirmation is issued showing the confirmed event date. The contract binds You and all the members of Your party and by booking You and Your party agree to become members of Wild Kabn Kitchen Supper Clubs, which is free to join. It is your responsibility to ensure that all members of Your party accept the terms of the contract set out in these Terms and Conditions of booking. Failure to disclose all relevant information or comply with these terms may lead to termination of the contract and loss of the booking.


Information about features, facilities, and services, is, to the best of our knowledge and belief, accurate at the time of publication, however, We cannot guarantee that these services, features, and facilities will be available during the event you attend.


We accept no responsibility for loss or damage of property, vehicles or vehicle contents or valuables belonging to guests during their stay or time at the Venue.


Any personal items found will be held for a maximum of three months, following which they will be donated to charity or destroyed.


To the maximum extent permitted by applicable law, You agree to release, defend (at Wild Kabn Kitchen’s option), indemnify, and hold Wild Kabn Kitchen (including its personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) Your breach of these Terms and Conditions (including any supplemental or additional terms that apply), (ii) Your improper behaviour at the Venue, (iii) Your interaction with any other guest, your stay at the Venue, participation in an experience or activity, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use of any features, facilities and services, and (iv) Your breach of any laws, regulations or third party rights.


Availability Policy


The events that We offer are limited, and We cannot guarantee availability. We reserve the right to refuse sale.


Booking Policy


Bookings must be made directly on Our website and the full balance of the event is payable upon booking. All major debit and credit cards are accepted. 


Booking is taken on a provisional basis until all funds have been paid in full and cleared through the payment system (Stripe). Until the booking is confirmed, it can be cancelled at any time with prior notice.


Please ensure that You are not using fraudulent sites. We are not responsible for any losses You may incur through booking mistakes. 


In making a booking you accept responsibility for any theft, breakage or damage caused by You or any member of your party to any property at the Venue and agree to indemnify us in full for any loss that we may incur as a result. Please do not take any items away from the Venue with You.


If You have obtained a ticket in breach of these terms and/or if you breach any of these terms then Your ticket shall be void, and all rights conferred on You or evidenced by such ticket shall be void. If you seek to gain entry to an event using a void ticket then we reserve the right to eject you from the event and you may be liable to legal action for trespass. Void tickets are non-refundable.


Prices


The price of the events are shown on the website and include all taxes. Prices may vary.


We do not permit the resale of tickets. However, We do allow guests to gift their ticket to a friend or alternative guest, if they are unable to attend. Please contact us as soon as possible to let Us know if the dietary requirements are different from those attending the original booking. However, we cannot guarantee that We will be able to cater for the dietary requirements of the new guest(s).


Cancellations and Amendments


By Us:


Where reasonably necessary, we reserve the right to make alterations to the published event. Please be aware that, in some circumstances, the stated guest chef may not be able to attend due to circumstances outside of Our control. In such instances, We shall use reasonable endeavours to find an alternative chef.


We reserve the right to cancel Your booking for any reason including but not limited to dangerous weather, safety issues and unforeseen circumstances. In the unlikely event that We have to cancel, We will try to give You as much notice as possible. Please note We do not offer refunds or any other form of compensation if We cancel; however, We will try to offer You the opportunity to rebook a future event at the same price.


We strongly advise that guests take out an appropriate travel insurance policy or holiday cancellation insurance to protect yourself in an unlikely event (including Force Majeure) or sudden change of plans.


By You:


Your booking is non-refundable and the total invoiced sum is required upfront in order to secure Your event. However, if You give Us more than 30 days’ notice, Your booking may be transferred, subject to availability, to another day within 6 months of Your original booking date. If You are not able to re-book within this 6-month period, We are unfortunately unable to honour your booking.


For the addition of extra guests to Your booking, please inform us as soon as possible and we will try to accommodate You if We can. Please note that this at Our discretion based on the current number of tickets sold and ticket prices may vary. When calling to enquire about additional guests, please do give us as much advance notice as possible. Please note, We are not able to refund tickets for reductions in the numbers of guests or guests who don’t attend the Event for whatever reason.

 

Arrival and Departure Times


Detailed directions of how to get to the event and location will be provided with the booking confirmation. 


Supper Clubs - the supper clubs will commence at 6.30pm. If you are late, you may not be allowed access and will not be refunded. Supper Clubs will end around 10.30pm so we would advise any pick up around that time. 


Camping must be agreed by us ahead of your stay and is subject to availability - if you are camping overnight we invite you to arrive
after 3pm on the day of the event in order to erect your tent. No access will be provided before this time. Please ensure that you have packed up all Your belongings and checked-out by 11am the following morning. Guests are kindly asked to leave the camping site clean and tidy and in the same condition as they found it on arrival. This includes making sure no litter is left on site.


Sunday Lunch Clubs - the Sunday lunch will start at 1pm. If you are late, you may not be allowed access and will not be refunded. The lunch will end around 3pm the same day. 


Kabn Company Guests - if You are staying at Kabn Company after a supper club event, it is an approx. 20-25 minute walk to the event. Please leave plenty of time to get to the Location. If the weather is bad, the Chef may be able to drop you home but it will depend on timings so please make sure you bring a warm, waterproof coat and torch just in case you walk!


Foraging Terms


If We offer any foraging experiences, You agree to the following terms:


Foraging experiences are attended by You at Your own risk - by its nature foraging is not free from hazard as many wild plants and mushrooms in the UK are poisonous. You are free to choose whether or not to consume foraged items which the guide(s) give permission to taste. You must follow all instructions of the foraging guide(s) at all times and must only consume items which you have been expressly instructed are edible. 


Consumption of foraged items can cause allergic reactions in certain individuals. You must not sample any of the foraged foods in the tour if You are pregnant, breastfeeding or have any known allergies.


You must remain with the foraging guide(s) at all times and must not return to any area to forage alone after the event. We are not responsible for any incidents that arise due to a participant attempting to apply knowledge learned from a foraging experience and we do not recommend that you forage without an experienced guide.


Any discussion of medicinal uses is for interest only and does not constitute medical advice.


If We deem that You are not behaving appropriately during any foraring experience, We may ask You to leave and Your ticket will not be refunded.


Although We have taken steps to ensure that Our foraging guides are experienced & capable foragers, We and Our foraging guides exclude any and all liability whatsoever and howsoever arising in relation to any foraging event to the fullest extent permitted by law.

 

Dietary Requirements and Allergies


If You have any dietary requirements, please inform us at the same time as you make Your booking and We will do Our best to accommodate You. Unfortunately, at this time
we are not able to cater for guests with allergies


Liability and responsibility


Although we take health and safety very seriously, this is an event where there are naturally certain hazards (including the weather) that we cannot eliminate. Note that Lyme Disease and various disease and infection can stem from contact with ticks so please be aware of them particularly during the summer. Please be aware of midges during the summer months and bring bite spray / deterrent spray. There may be loose stones/steps, slippery paths/steps, muddy/boggy/icy areas, unlevel terrain with holes/logs/bumps etc. and the old buildings (including the greenhouse) may have loose windows/tiles/door handles etc. Guests should take great care while on site which includes following signs and instructions (where applicable). We will have firepits on site and all cooking will be done over fire so. We advise You to stand a safe distance from these and take great care when moving near the fire pits / cooking frame. We will ensure that there is access to a first aid medical kit and a fire extinguisher on site. We ask that guests bring their own torches to assist with overnight camping. You should also bring any medical equipment You require - it is a remote location and there are no pharmacies or medical facilities close by. We exclude any and all liability whatsoever and howsoever arising in relation to the event to the fullest extent permitted by law.


Smoking and Vaping


This is a non-smoking event. Vaping or smoking anywhere on the premises will result in immediate termination of Your ticket and forfeiture of all payments. This must be strictly adhered to and any damage caused by smoking (including the removal of cigarette buts from the vicinity) will be at your expense. A flat fee of £300 will be charged to cover any expenses if there is any evidence of smoking on the site.


Drinking and Drugs


Wild Kabn Kitchen has a strict zero tolerance policy on drugs and any illegal substances. If You are found to be under the influence, Your ticket will be terminated with immediate effect, without refund or compensation and the police will be notified. 


You are not permitted to bring alcohol to the Venue, however, We may provide bar services from time to time at Our discretion. Guests are reminded to drink responsibly.


Customer behaviour and conduct


Wild Kabn Kitchen is located on the Ardkinglas Estate. This is a working estate with commercial operations located close by. Please be conscious, careful and respectful of the land and the other residents who live and work there. Wild Kabn Kitchen shall have no responsibility for loss, damage or injury that occurs on the land or in the loch.


We reserve the right to refuse You entry to and/or remove You (without refund) from any event, including without limitation, if You behave in a manner which is offensive or inappropriate; if You behave in a way that has or is likely to affect the enjoyment of other persons at the event; if you use threatening, abusive or insulting words or mannerisms; if, in our reasonable opinion, you are acting under the influence of alcohol or drugs; if you fail, when required, to produce proof of identity or age; if you breach these terms; or, if your ticket is otherwise void.


We reserve the right to conduct security searches from time to time including searches upon exit of the event site and to refuse admission to you, or remove you from the Venue should you refuse to comply with such searches.


We reserve the right to confiscate any item, which in our reasonable opinion may cause danger or disruption to any other persons or property at the event.


You must comply with any and all instructions given to you at the Venue and event by staff and You may only camp where instructed to. We accept no liability with regards to you tent or sleeping arrangements. No campfires may be lit anywhere on the Estate. Only designated firepits can be used. Please do not attempt to move or touch the firepits while lit or whilst still hot.


You give your express consent to your actual or simulated likeness to be included for no fee within any film, photograph, audio and/or audio visual recording to be exploited in any and all media for any purpose at any time throughout the world in perpetuity. You further agree that the copyright in these materials is owned by Wild Kabn Kitchen LLP.


If, before or during the event you have a complaint in relation to the event, please inform us promptly so that we can do our best to assist You.


We ask that You dress appropriately for the event (noting that it is the West coast of Scotland and the event is outside so it may be very cold, wet and windy even in the summer!). There might also be midges during the summer months. 


Please be considerate with phone calls, and other noise. When camping overnight, noise must be kept to a minimum after 11pm and before 8am.


Please note all guests who are
not camping overnight with us must vacate the premises by 11pm at the latest. Please keep all noise to a minimum when leaving the Estate as there are residents who live nearby.


Information about you


By providing us with your personal information you consent to our processing your data for data analysis. We will only use the information that you provide to us for the purposes contemplated in these Terms and Conditions, informing you about similar services which we provide (unless you tell us that you do not want to receive this information) and improving the services which we offer to guests.


Our online booking and payment systems which store your data are password encrypted to protect your personal information from access by unauthorised persons and against unlawful processing, accidental loss, destruction, and damage. We may retain your personal information after we have ceased using it for the purposes set out in these Terms and Conditions, or for as long as the law requires.


Prohibited Areas


Please stick to the designated areas for the event which will be clearly marked. This is a working Estate so for Your own safety please do not explore undesignated areas.


Off-grid


The event will be off-grid so please bring torches.  There will not be any Wi-Fi but (depending on your phone provider) there may be phone signal on site. There will be a portaloo on site but no showers. Wild Kabn Kitchen shall not be liable for any temporary defect or malfunction of any equipment, machinery or appliance on the site.


Children


Unfortunately, due to the nature of the events and the fact that this is a working estate, We do not permit entry to those aged under 21 unless agreed and approved by us prior to arrival. Please bring ID with you.


Pets
 


No pets are allowed on site at any time. This is a working Estate with livestock in the surrounding fields where animals such as dogs can cause distress. Bringing pets will result in immediate termination of Your ticket and forfeiture of all payments. 


Parking


We have a limited amount of parking on-site. Wild Kabn Kitchen will not be held responsible for any damage to or theft of guests’ vehicles parked on-site.


Damages


We reserve the right to charge You for any and all damage done to the Location by You. 


Jurisdiction


This agreement is governed by the laws of England and Wales and is subject to the exclusive jurisdiction of the English courts.
